Surgeons performing breast cancer operations are frequently cited in malpractice cases.
1 However, the reasons behind malpractice claims continue to be confusing and mysterious owing to the lack of transparency in our system. Unfortunately, medical malpractice claims in the USA have mostly been an adversarial system with the traditional response of deny and defend. Little information is shared in this system, and little is learned from medical errors and unexpected outcomes. As a result, the system has not effectively promoted quality improvement, resulting in patient dissatisfaction, defensive medicine, and patients vulnerable to repeated errors. …
