Informed Consent Form for Surgery in India — Changing Scenario

Abstract

Obtaining an Informed consent before any surgical procedure has been in vogue since 1957. With the increasing rates of litigation against doctors, it has been found that not having obtained an explicit and adequate informed consent is the main reason for cases to be filed against surgeons. The electronic era has made significant upgrades on the way consent can be obtained through video- counselling, eConsents etc. There are certain loopholes seen in obtaining consents in high volume surgical centres where untrained residents get the consents and in old and frail patients not able to give effective consents. With the law stating that each consent should be customised for the patient, without use of general pre-printed forms, it is all the more important to understand clearly all that an Informed consent taken in today’s practice should contain.
